A party unable to pay court costs must submit the court-prescribed completed poverty affidavit, after which the Clerk accepts the filing without costs, subject to possible further inquiry by the trial judge.
If a party is unable to pay court costs, then the party must submit a poverty affidavit requesting to have such charges waived on the form prescribed by the court. The completed affidavit must be submitted to the Clerk of Courts who will accept the filing without costs.
