Filing Timing and Cure Windows

Except during a District Clerk Office emergency, an application for immediate or temporary relief must be filed and assigned to a court before it may be presented to a judge.

2.1 Except when the District Clerk's Office is not open for business due to an emergency, no application for immediate or temporary relief shall be presented to a Judge until it has been filed and assigned to a Court as provided in these Rules.

When the District Clerk's Office is closed because of an emergency, a case requiring immediate judicial action must be docketed and assigned at the earliest practicable time, and all writs and process must be returnable to that court.

2.2 Whenever immediate action of a Judge is required when the District Clerk's Office is not open for business due to an emergency, the case shall, nevertheless, at the earliest practicable time be docketed and assigned to a Court as provided by these rules, and all writs and process shall be returnable to that Court.

Sealing & Redaction Procedures

The Brazoria County District Clerk and County Clerk are authorized to seal educational records before issuance of a formal sealing order.

The Brazoria County District Clerk and the Brazoria County Clerk are hereby authorized to seal educational records prior to any formal sealing order being issued.

The Brazoria County District Clerk and County Clerk are authorized to seal medical, psychiatric, psychological, mental-health, and competency records upon filing and before issuance of a formal sealing order.

In order to comply with Federal HIPAA and State medical privacy laws and educational privacy statutes, the Brazoria County District Clerk and the Brazoria County Clerk are hereby authorized to seal any medical, psychiatric, psychological, mental health, and competency records upon filing of the same, prior to any formal sealing order being issued.
